Drivers with Recorded Violations

If a CDL/CLP driver has a drug and alcohol program violation recorded in the Clearinghouse, the CDL/CLP driver is prohibited from operating a commercial motor vehicle (CMV), or performing other safety-sensitive functions, until they complete the return-to-duty (RTD) process. The tables below provide a snapshot of the number of drivers in the RTD process with their status in the Clearinghouse as of INSERT_REPORT_DATE.

Violations Reported to Clearinghouse

Employers, or their designated C/TPA, and MROs are required to report violations of the drug and alcohol program in the Clearinghouse per 49 C.F.R. 382.705. This includes positive test results and test refusals. This section summarizes the violations reported to the Clearinghouse since January 6, 2020.

Positive drug tests account for INSERT_PERCENT_POS_BY_VIOLATION of the total violations reported. Below is a detailed breakdown of the number of times each substance was identified in drug test results. (Amounts do not reflect unique tests, as more than one substance can appear in a positive drug test.)

To view a driver's Clearinghouse status or record, employers query a driver's information. Employers are required to conduct Clearinghouse queries when hiring a new CDL/CLP driver and annually for all CDL/CLP drivers they currently employ.
